I have an old UBUNTU Hardy disc. If I download a new UBUNTU Hardy, will it have the new updated Linux Kernel?

No it won't.
No matter how many discs you download they will have the same kernel. You'll have to update it once you install Ubuntu...

The iso is the iso. In a manner of speaking, each 6 month release is a shapshot, frozen in time until you dist-upgrade six months later. The exception to this is kernel upgrades and necessary security updates. Additionally, you can get certain updated programs by enabling the backports repository. But if you were to turn backports off, each six month upgrade would remain as is until the next release.

Thanks for your help. The reason I ask this is, that I am installing UBUNTU on a USB and it works fine. I can even download the restricted Broadcom driver and maintain installation on next boot. The only problem I have, I believe the Ubuntu CD has the 16 kernel and I think the 2 updated kernels are 18 and 20. When I try to do an update on the USB, it crashes in reference to "trying to install sudo" I am presuming that by updating the kernel is causing a casper error which is what is used to maintain persistence on the USB and cut down on the read/write cycles.
There is a 8.04.1 iso available for download since July 2008, which compares with the original 8.04 from April. LTS downloads are updated every 6 months.
I can't remember what kernel was in 8.04.1, but I believe it was -18.
