Bull crap. Don't take his truck. It's not worth it. If the truck is that new and it has a rebuilt engine, you don't want it. Get your money. Call a lawyer. That's what I'd do.

Potentially, getting an attorney may cost more than settling. One question no one has asked is how financially well off is this individual? Consider should you sue and win, collection may be an separate issue. I might suggest (if he's serious) taking his used truck and he provide additional monetary compensation for the difference.
I find it odd and would ask the police why they didn't ticket this individuals for not carrying insurance, unless he's sitting on a bond. In which case I would call an attorney.
Was anyone injured or inconvenienced in the accident? That may also be a consideration.
Obviously, I'm not an attorney and would refuse to advise you on the appropriate action or whats in your best interest. But will suggest investigating this individuals financial situation prior to any attorneys or court actions. It may simply be in your best interest (if this person is insolvent) to make a deal.
