A report to be released today says Linux may violate nearly 300 patents, including 27 held by Microsoft, and warns that companies using Linux could become targets of multi-million dollar lawsuits.

Ubuntu does'nt violate patents does it?


Linux creator Linus Torvalds says he isn't worried by suggestions that Linux may infringe on patents. "Hey, there 'may' be life on Mars. What does 'may' mean?" he says via e-mail, adding that if Linux really does infringe on a patent, he'll just rewrite the code to sidestep the problem.

The article is over 1 year old, nothing but old news...

As for violating patents, the answer is most likely. The US patent office will pretty much patent anything under the Sun (the star) in regards to software. Europe isn't far behind either, but as far as I know the patents are not enforced despite the EU's attempts (http://swpat.ffii.org/pikta/xrani/index.en.html)

My "favorite" software patent would have to be MS's double click patent.

Looking how many really shallow and stupid patents are granted I am sure that Linux and many other free software infringe some of them. I mean come on, they granted patents on things like progress bars, hyperlinks, electronic shopping carts, remote authentification, buy with one mouse click and such stuff. Of course many patents won't hold before court, but before a court rules otherwise they are valid once granted.

Actually I think it's really hard today to write software which doesn't infringe any patents at all.

The Greeks have their own claims, as you can read here (http://humorix.org/articles/2005/09/reparations/). Seems like in Antiquity Greek was spelled without the "r".

If anyone has access to "The Economist" magazine, they might want to read the October 22nd-28th (2005) special survey on patents. Of special interest in the section entitled: "An open secret"

It explains how many firms, such as IBM, have granted the open-source community the right to use their patented technologies (in an unrestricted fashion) and how these firms believe that this action gives them some edge in the market place.

If Microsoft tried to sue Linux and Apple for infringing on their double click patent the result would most likely be a software patent nuclear war.

If microsoft tried to sue linux or its users for anything there would be alot of backlash - And everyone would move to BSD.
