This time, IM2 (http://www.im2.com) is the violator! :evil:
Unlike Microsoft, this one HAS TO BE a rip-off.

Why does it have to be a rip off? More likely to be a rip off of the MS version...

And if we're going to go for logophobia, how about Joomla's logo?

Actually they ripped off the Ubuntu backports logo. But it's more than likely a coniceidence.

Years back, NBC dumped their interlocked NBC letters to go to a simple, stylized "N". They paid megabucks to some ad agency to design it. After they rolled it out, it turned out that Nebraska Educational Television had the identical "N" (except for the colors). IIRC, NBC paid of the Nebraska folks to gain exclusivity to the design they paid the advertising people to come up with.

To all of this ripping off/copying of the Ubuntu logo, question is, does Ubuntu have a patent for its logo (coz Canonical or whoever from Ubuntu dev can ask for royalty - I think)?

Almost correct. IIRC, they were sued, paid the fine, then slapped the peacock behind it.

I mean put a peacock behind the N. I don't want it to seem they "slapped the peacock" :D

You don't need to patent a logo...it is protected by copyright the moment it comes into existence, as long as you can prove that you are the legitimate copyright holder.

you can, however register it as a trademark for certain goods and services. Canonical have applied for a TM registration in the USPTO, as you can see here (http://tess2.uspto.gov/bin/showfield?f=doc&state=ci91tk.3.3).

A search of the USPTO's TESS trademark database show several applications for the UBUNTU mark; some of them are in classes of goods and services that will certainly be deemed unlikely to cause confusion (i.e., you can be pretty sure that UBUNTU-marked clothing or UBUNTU-labled wine are not UBUNTU-marked software or consulting services).

I think this one is quite not so clear cut case. I think IM2 existed first before Ubuntu.

Reopening a 3 year old thread, yay.

I didn't want to make a new thread for this so.

The logo (almost a 100% copy) is being used on the site of my favourite football team.

Actually, it's not copyright. While you CAN copyright a logo, it's a trademark you add to a logo.
