Actually it's not, it's basically a hack like ASF recorder.

Thing is, this wouldn't be possible (or maybe just much, much harder) under TCPA. And this event just gives those big publishers more incentive to push microsoft and intel and the lobbyists who pressure the politicians into locking down computer hardware.
