ok i recently bought a inexpensive laptop and im planing to install ubuntu 13.04 on it
i have created a usb recovery disk for windows 8 and i was wondering if in the event i have to return the laptop with in the 30 day period can i use the usb to put it all back
i know i could dual boot but its a toshiba and for some reason its a pain in the rear to get it to dual boot

There are two recovery systems. One is the Microsoft which is just to repair Windows. The other is the vendor image of drive as purchased. Which did you make.

Also best to backup efi partition and entire Windows system.

Wait 30 days before altering what you purchased or you might be refused a refund.

Another thing you might want to do before anything else is to boot up a live CD or USB of Ubuntu and test all the hardware in the live session: wireless, webcam, screen brightness keys, SD card reader, bluetooth, etc, etc. You may be unlucky and have some hardware that doesn't work well in Linux and you may conclude that the tweaking required to get it working properly isn't worth the effort.
