so here is my problem, when i right click with the mouse and release the button sometimes the menu goes away..

in my experience it should stick open to let me choose an action.

im not sure how to fix it, as its very annoying..
i right click and end up choosing the top action instead of what i want.

gnome-shell 3.6
ubuntu 12.10

The menu comes up on mouse down but if your mouse moves slightly out of the box it will disappear on mouse up.
Does the same thing happen using the menu button on your keyboard.(next to Right ctrl)
Try different settings in system settings > mouse
ie sensitivity and acceleration

thats almost exactly what is happening, its like the menu open on mouse down and then close on mouse up.. even tho i havent chosen any action it almost always will do the top one..

witch is new folder in file manager and back in chrome.

very annoying.

sensitivity and acceleration is for movement, not mouse clicks.

im not sure if there is a mouse click option for the right mouse button?

i have pointer speed and double click speed.. no other mouse options.

its right button up that needs to be cleared or something.

What release are you using.
I remeber one release was bad for this.
The reason I mentioned sensitvity and acceleration is because using a high sensitivity can, as you click move the mouse slightly
causing the menu to close when released if outside the popup or trigger the top menu item if inside.
Did you test by not touching the mouse and use the menu key.

Here is a pic of what seems to help for me. You will need to play with your settings to find the best for you.
