View Full Version : Someone stealing the Ubuntu logo?

Hey guys,

I was going around some forums at Adobe when I found this: http://forums.adobe.com/thread/1042514

It looks like someone was looking for some help with some photoshop image. I quickly noticed that he was using a logo I thought looked rather familiar. Turns out the rest of the website uses the logo as well (in a rather hideous colour pallette too). Check it out here: http://www.opticianclub.com/

I don't think they're allowed to do that: Ubuntu Trademark & copyright policy (http://www.ubuntu.com/aboutus/trademarkpolicy) (I didn't read the whole thing). To bad they didn't put a legal contact in the page, maybe legal@ubuntu.com will work.

(Since you're the one who discovered it, I'll leave it to you to contact ubuntu/canonical)

To be honest, it's just a generic logo, they could easily have come up with it, never knowing that Ubuntu uses the same. It's not like most people would recognise it.

I've seen several that are very, very similar.

That's what I usually say about these people just trying to find things to call out. But this one is the pretty much exactly the same, with the same angle of rotation and everything, other than colors. Personally, I don't give a rip, but this is a pretty obvious copy.

Whether they "know" it's a trademark or not, it is an infringement. Generally this sort of thing is handled diplomatically. If they don't comply with Canonical's wishes after being asked nicely, things escalate.

The infringing party rarely wants to bear the cost of legal action. They may take action themselves against the party they paid to "come up with" the logo.

In any case, it should be reported.

I think there's enough difference there that there is no danger of confusion. It certainly looks "inspired by" though.

The opticianclub logo on the other hand definitely looks like trademark infringement to me.

Ubuntu made 4 people into 3, the opticianclub changed the color. Both changes seem about the same to me. It's just silly to be up in arms about things like this when a) you aren't with the companies in question and b) the logo was stolen or "inspired by" another one in the first place.

Report it and let the lawyers decide. Like I said, this sort of thing is usually resolved diplomatically because of the cost of litigation.

We don't know exactly how the "four friends" trademark is defined. The Canonical trademark issue with regard to that may be moot.

How do you know they didn't have the logo first?

Just because the website is only a year old, doesn't mean the logos is.

That depends. If the perpetrator creates a negative impression and it uses the Ubuntu logo, then it affects all of us. In this case, I doubt there is any overlap; but still, one needs to be careful. What if the site in question were, say, to give terrible customer service or to be a scam? (I'm not saying it is; I'm sure it is a bona fide site.)
