Hello,

Is this legal? (earrings featuring the ubuntu logo (http://executeables.com/products/ubuntu-logo)) I have skimmed the pages about ubuntu trademark issue, but can't find a direct answer to this question. I know this kind of stuff just flies under the radar for the most part, but I am curious if it's actually allowed, if it's not allowed, or if you need to get permission on a case-by-case basis.

I had skimmed that, but most of it seemed to be about derived software or services. Then I saw the part about physical merchandise. I not interested in flagging this person, I just have a similar project I've been interested in. I will contact canonical about my project.

I'm not attorney, and I'm certainly not in a position to speak for Canonical, but FWIW I had a similar question about the use of their logo on some of my web sites and they wrote back quickly with a definitive and helpful answer.

They key with trademark usage is that it can help a brand or detract from a brand, depending on how it's used. Using the Ubuntu logo to promote distasteful things would obviously be bad for the brand and I'm guessing they'd prefer it not be used for those. But in their reply to me they welcomed use of the logo in ways that promotes the work they're doing in a positive light.

How this applies to something entirely unrelated to software like earrings is anyone's guess, but I would encourage anyone uncertain about use to contact the Canonical legal team and if your experience is like mine you'll find them helpful and prompt.

Love the <head> </head> ones! But of course I used to have a T-shirt with <body> </body>...
