A very important battle is currently being waged, & the EFF (with others) are attempting to get the rights of "First Sale" clearly sorted out by the Supreme Court, so that software & other media producers can't use "magic words" in a license, to take away the ability for people to actually own a product & thereafter lend it, sell it, or travel overseas with it.

It is a long read, but well worthwhile as the argument is very well presented (as it certainly needs to be):

Good on the EFF!

Talking about right of first sale always makes me think back to when MS first started 'licensing' Windows rather than 'selling' it; Bill Gates was interviewed on TV by some apparently famous American TV personality (I'm not American, so don't know who it was) who thought he had Gates backed into a corner when he said "but this means people won't be able to install their copy of Windows on both desktop and laptop, they'll have to buy two copies!"
He was a bit stunned when Gates just looked at him and said "That's right."
