Just saw this posted on another site. Is this a joke?
Because if it isn't, I don't know what to say.

Still don't now how they won that case against the Beatles when Apple Corp were using an apple logo before personal computers were even thought of.

This is reminding me of Microsoft trying to claim copyrights and trademarks over the word "Windows" and Adobe trying to do the same thing for the word "Flash".

I wish IT companies would spend more of their time making their products suck less, and less of their time making idiots of themselves in public. Jobs needs a good old fashioned **** kicking.

Or how about Kotex? :D

I can understand getting the rights to iPad, but not pad.

I wonder if Jobs tried to own the word 'Phone'?

I wonder if he owns stock in that company he buys black turtlenecks from?

I think he really want to have letter i, to satisfty his ego. But luckily, IBM has OS called IBM i.

PS: Look (http://patentauthority.com/2010/03/apple-buys-ipad-trademark-from-fujitsu/), Fujitsu never dreamed that they will cash in on that.

Apple, out there, all day, every day, working hard to prove that while microsoft arent exactly saints, there could be worse people to have a monoploy.

I've hated Apple since I first used one back in 1994 or 95. I was always fixing them for my teachers or showing them how to use them.

iPad=overpriced garbage

Steve Jobs=idk, that guy's just angry that google is beating him

Isn't there a big issue at the moment of iPads overheating if you use them in the sun?

Oh look another thread that has nothing to do with the linked article or its subject.

Apple doesn't own the trademark to "Pad". Even the article points that they own only iPad and MacPad.

What they did (from the article) is starting to ban apps in the Apple App Store with the word Pad in it.

If the devs have a problem with that they should move to another platform or sue them.

Personally this is a completely unethical, unprofessional and douche thing to do. But then again, its Apple.

Jobs response to Chris Ostmo:

It's just common sense not to use another company's trademarks in your app name.

So they don't allow updating because the app is infringing on a TM which they don't even have :|

Kind of like how Canonical won't allow any Ubuntu derivatives to have "buntu" in their names? ;)

I'm glad I managed to buy a ThinkPad before Lenovo gets sued. This thing is awesome, and it will be so much more awesome if it becomes illegal.

Kind of like how Canonical won't allow any Ubuntu derivatives to have "buntu" in their names? ;)
That's actually a good point. This is one Canonical policy I never agreed with. Not sure if it's actually enforceable though.

It's enforceable because people perceive that it is. They have forced people to change names before.

Now if those people would have refused to change their name, I doubt if it really would have been enforceable. But most of the time, it's normal, little people like us who are afraid to get taken to court by a big company, so we just cave in.

MaxIBoy
April 13th, 2010, 08:07 PM
Canonical isn't exactly a "big" company.

Unless I was making a parody or using the suffix for personal expression, I wouldn't violate their policy out of respect. But I certainly don't agree with it.

Mr. Picklesworth

Kind of like how Canonical won't allow any Ubuntu derivatives to have "buntu" in their names? ;)

First, IANAL.

See: http://www.ubuntu.com/aboutus/trademarkpolicy

Now, the thing is, "buntu" is in active use for branding. Eg: Lubuntu, Kubuntu, Xubuntu. A distro being called *buntu has some meaning. Consider how Mozilla's Firefox branding is licensed differently from the browser. A bit of a pain, but it means that a browser with the Firefox name and logo can be distinguished from an unofficial Firefox derivative.

While the word "Ubuntu" isn't a recent (or, likely, attributable) invention, its use in this context is pretty unique so can acceptably be considered a trademark as far as computer software is concerned. The completely invented `buntu suffix is now frequently used to refer to Kubuntu, Xubuntu and Ubuntu in one word, so it would be really ugly for everyone (including users) if it suddenly referred to some ugly home-grown distro by Asus, as well.

As far as Canonical has demonstrated thus far, it isn't a “never utter the word or our lawyer(s) will eat you for breakfast” type of trademark, but more along the lines of “we want to make sure people aren't confused about what our product is.” Like Mozilla. (Although it does have to be actively defended to be considered a valid trademark).

Oh, and I think Steve's argument here is absurd. I would laugh if they tried to enforce it in the real world, but they won't; Steve knows he's full of it.
(Unless his reality distortion field backfired...)

That wouldn't stand in any sane court on the planet. Apple is simply abusing its monopoly position in relation to the App store.
