Small Design Firm Sues Microsoft Corp. Over Bing Name-DJ

Dow Jones reported that a small computer-based design firm in Missouri is suing Microsoft Corp. for trademark infringement over the name Bing. Bing! Information Designs LLC is alleging trademark and unfair competition against Microsoft in its suit filed in a St. Louis circuit court, saying Microsoft's use of the name dilutes the value of it and confuses the public about the companies' relationship to each other. It said it has used the Bing name since 2000 and has pending applications to register the mark. Microsoft launched its revamped search engine with the Bing name in July. The company is seeking actual and punitive damages including having Microsoft pay for corrective advertising to remedy the confusion it caused. Pacific WebWorks, Inc. announced that it has reached an agreement with Google Inc. to settle the trademark infringement complaint filed by Google in the U.S. District Court for the District of Utah on December 7, 2009. At a hearing in the United States District Court, Central Division of Utah held on December 16, 2009, counsel advised the Court that the parties had reached an agreement in principle to settle the lawsuit under terms of which Pacific WebWorks would cooperate with Google's request for expedited discovery.

Dow Jones reported that EU regulators signalled they could clear Oracle Corporation's $7 billion takeover of Sun Microsystems, Inc. after the U.S. software company promised measures to ease competition concerns. The European Union's executive European Commission said it was optimistic a satisfactory outcome was possible. Oracle Corporation Issues Q3 2010 Outlook In Line With Analysts' Estimates-Conference Call

Oracle Corporation announced that for third quarter of 2010, it expects total revenue growth on a non-GAAP basis to range from 3%-6% at current exchange rates and negative 3% to flat in constant currency. On a GAAP basis it expects total revenue from 4%-7% at current exchange rates and negative 2% to positive 1% in constant currency. Non-GAAP earnings per share (EPS) is expected to be $0.36-$0.38, assuming current exchange rates and from $0.33-$0.35 in constant currency. GAAP EPS for the third quarter of 2010 is expected to be $0.26-$0.28 using current exchange rates and $0.23-$0.25 assuming constant currency. The Company reported revenues of $5.504 billion in third quarter of 2009. Red Hat, Inc. Reaches Settlement In Restatement Class Action Litigation

Red Hat, Inc. announced that it has reached an agreement in principle to settle the class action lawsuit, pending in the United States District Court for the Eastern District of North Carolina, brought on behalf of a class of shareholders in connection with the restatement of financial results announced in July 2004. Red Hat has recorded, in its quarter ended November 30, 2009, a reserve in the amount of $8.8 million for its portion of the settlement. Red Hat plans to exclude this one-time charge from the non-GAAP results Red Hat reports for its quarter ended November 30, 2009, when these results are announced on December 22, 2009, and will provide a reconciliation to GAAP results at that time. Dow Jones reported that the European Commission accepted to settle its remaining antitrust issues with Microsoft Corp., ending a decade-long battle over the software giant's monopolistic business practises. The European Commission, the EU's executive arm, agreed to abandon its case against the Company over whether the Company is illegally abusing its dominance in the Internet browser markets without a fine, in return for a legally binding commitment from the Company to start marketing rivals' browsers alongside its own Internet Explorer. The commission had accused the Company of crushing rivals and stifling innovation by including its own Internet Explorer browsers in its dominant Windows operating system.

Microsoft Corp. Suspends Juku Amid Plagiarism Charges-DJ

Dow Jones reported that Microsoft Corp. has suspended MSN Juku, its new microblogging service in China, amid allegations that much of the code was lifted from a Canadian startup, Plurk. The Company said it was suspending MSN Juku, which was developed for MSN China by a third-party independent vendor, while it investigated the charges.
