uninstall a dual patition of Ubuntu 8.10 (to maintain the 9.10 vesion)
I had Ubuntu 8.04 erroneous upgraded for 9.04 (...)
as a result I am currently working with the installed and upgraded to 9.10 and partition with OS Vista.
how do i remove the system files and retain the users' data files?

Theoretically, you could delete everything except the /home folder on that partition. You'll probably need root privileges, so use <gksudo nautilus>.
