I just stumbled across something while sorting my music that I find very odd. The same picture is used as the cover of two completely different bands: Dave Matthews Band - Under The Table And Dreaming and Kharma - Wonderland. Take a look: HERE (http://www.sotd.se/blandat/dmk.jpg)

Probably because RCA who released the DTM album owned the MTM label which released the Kharma album.

That happens because probably the picture in the album covers is sold without exclusivity. This is a very common practice in image banks. If you want exclusivity, you have to pay a lot more for the image rights.

Is it also possible that the exclusivity rights for that image were bought by the record label, so they can do whatever they want with it.

Back in the days of slide film, many amateurs would feed their photography habits by selling shots to stock photo agencies. The photographer would get a small residual royalty payment every time someone bought reproduction rights to his otherwise anonymous stock image.

Remember, just because copyright allows you to reserve rights doesn't mean you can't also sell certain of those rights in a number of ways.
