This morning I went to my local Fresh'N'Easy grocery store and to my surprise i found the Linux Penguin on a cereal box.

I think that is awesome, Canonical should contact the company and make a deal to include a free Ubuntu ship-it CD in every box! :D

I love it! Better yet, they can ship Live CD's in specially marked boxes of Ubuntu-O's. Who here wouldn't buy a box of Ubuntu-O's?

EDIT: I just noticed the footprints on the box's "artwork." What's going on there? Did the penguin walk backwards and underneath the spoon?

Wrong. The idea of Tux himself is not copyrighted but pretty much every single image of Tux is copyrighted in one way or another.

In particular, this tux is clearly a derivative of Overlord59's Tux G2, which is licensed under the CC BY-NC-SA.

Using this Tux on a product that is for sale is clearly a violation of the license that this Tux is under.

oh i guess TUX is opensource and is distributed under GPL!!! lets enjoy till tux does good works, if tux is used for some bad things, lets then stop it:)

read my thread once again, i told this is good, lets enjoy it, if some other company does certain bad things using TUX, then we'll stop, if i'm wrong please sorry,

This is bad, because it is a violation of the CC BY-NC-SA license.

Yeah, I was surprised and kind of delighted to see Tux on a cereal box at Fresh & Easy. I took two pictures with my cell phone.

At the time, I just figured it was GDFL or something so commercial use was okay. But it's clear from this thread that this is BY-NC-SA which does not permit using the work to advertise for another product (the cereal). Unless, of course, prior permission has been obtained from the author that goes around the license. Has anyone notified the author yet?

I'd hate to see Tux go from my favorite store. :)
But it's not good for a community artist to be ripped off.

I think I'll have to buy a box now as a souvenir.
