so i thought i would try to install it and same thing...

Do you know what graphics card your computer has? I don't install from a Live CD, but it seems to me there is an option to use Safe Graphics Mode (press F4, IIRC, or may be F6) to run without making any changes/install from the initial menu. HTH and good luck.

its a eVGA 6800GS card PCI-E

would installing into safemode work and then boots into ubuntu fine after install?

Boot the Live CD and when you get to the screen with all the options (Try Ubuntu, Check CD, etc)

Press F4 then select Safe Graphics Mode press Enter

Select Try Ubuntu press Enter.
