Tax Cut

Xandros/Linspire

Proprietary = any software where the developer deems that the software is their property and doesn't make the source code freely available.

Can you legally get copies of them for free?

Can you legally modify them to suit your needs?

Can you legally distribute copies (modified or as original) to your friends?

If no to any one of the above, then it's proprietary software.

Anything not Open Source.

The price doesn't matter, you have free proprietary apps and Open Source software you have to pay for.

- open source code is also copyrighted. If it were not you couldn't enforce the GPL, because you would have no ownership of the code or any moral right to dictate its use.

Not true.

See the GPL or the BSD license and a dozen others.

Any software that doesn't fit the open source definition (http://www.opensource.org/docs/definition.php) is proprietary.

I was making it simple and short.

And no it wasnt very long ago since the GPL became seen as form of copyright in comparison to.. well traditional copyright laws.

When I said copyright I meant copyright in a traditional scene.

I know how hard it is to distinguish it like that as traditional copyright is named copyright, and copyrights as the GPL are different form of copyright, kind of a subset.
So they are both copyrights, with one of them actually named copyright, hence the (C) signs... and "Copyright : John Morgan Sheppard".

I guess we could just all say "all rights received" instead of (C), and try to force trademarks and companies to use that instead of (C) or the word copyright.

I hope you get my point.
