3.9 kernel and broadcom drivers

sudo apt-get remove --purge bcmwl-kernel-source
sudo apt-get install linux-firmware-nonfree

this is what i did
installed 13.04
wireless did not work
installed non free firmware using ethernet cable
wireless worked

upgraded kernel to 3.9

wireless still works

so do i have a different br4311 chip, will i have a wireless problem?
do i have a wireless problem of which i am unaware?

Has there been any movement with this? I'm having some random lockup issues that are driving me to the point of trying different distros. I'm not sure if it's the 3.8 kernel being problematic or not (LM15 did the same thing, but it uses 3.8 as well... openSUSE was fine, but they're on 3.7). I installed kernel 3.9 on Ubuntu (and 3.7 for a little backtrace troubleshooting) but if I have no wireless on 3.7 or 3.9, there's no way I can tolerate using this machine for 1-3 days on end to see if it locks up. I have a 43228 chip. Everything I tried here so far hasn't worked. Any ideas?

I'm running Saucy Ubuntu Gnome on my Compaq netbook using the BCM4312 wireless chipset, with the current kernel 3.9.0-4 the wl driver works the way it should with zero problems
