Since the fglrx driver doesn't work for me on Ubuntu 12.10 with Unity (only right-click menu and terminal can be opened), I'm going to upgrade to 13.04 and see if it solves the issue.
Nice. The 3.8 patch has been applied to the edgers package:

Looks to be working well with 3.8-rc2 from the mainline builds. It still has the "Unsupported hardware" watermark though, so you'll need to copy across /etc/ati/control as previously.

Hello..
I'm trying to install the latest beta referenced in posts 17 using the instructions in post 3, but I keep getting errors when I install .deb packages.
I'm running 13.04, 3.7.0-7-generic # 15-Ubuntu.
Trying to patch manually, also use the pre-patched file located in post 17, nothing I do works. Do you have any idea?

That error message seemed to start a couple of driver releases ago and IFAICT occurs when building against a kernel not officially supported by AMD. The driver still works, though.
I'd recommend trying the edgers package. It works fine on my laptop (except for the watermark which is easy to fix).

Been running Catalyst 12.12 on the 3.8 Mainline dailies for a few weeks now( I updated Vi0l0's and jfernyhough patches and made my own *.debs. Never fails to build fglrx module when updating teh kernel. Everything is signed and I use Catalyst 12.10 control- so zero watermarks.
If ok w/mod I'll post links for my fglrx_9.010-0ubuntu1_amd64.deb,fglrx-amdcccle_9.010-0ubuntu1_amd64.deb and fglrx-dev_9.010-0ubuntu1_amd64.deb. I always end up w/ massive troubles from xorg-edgers ppa (they do warn truthfully!).
My debs only work w/ kernel 3.8
