HDMI output is giving me DVI on TV

My laptop is running ubuntu 12.10, I recently got a new tv, when I connect the hdmi output from my laptop to the tv the tv registers it as DVI and I get video but no audio, however my ps3 hdmi connection registers as hdmi on the tv with both audio and video.When running 12.04 this problem would also sometimes occur, but strangely sometimes the tv would register it as a hdmi.

I have searched other threads but to no avail.
