Patched B43 driver still gives the error "mon0 is on channel -1, but the AP uses..."

Hi,

I'm trying to get the Aircrack-ng suite working properly after upgrading Ubuntu. I keep getting the error message "mon0 is on channel -1, but the AP uses channel X" I realize that mean i need to patch the driver, but I've already done that and still get the same error.

My wifi card is as follows:
Broadcom Corporation BCM4312 802.11b/g LP-PHY (rev 01) using the B43 Driver
