Sadly VP8 is likely not going to escape the lawyers, it appears the VP8 implementation and spec borrows rather heavily from h264.

Also the quality of both the spec and the en/decoders leave much to be desired. Given that Google considers the spec final this is rather problematic.

Either Google has done their homework and it's just FUD
Or It's not FUD and they get their coders to fix it
unlike most F/OSS patent problems, Google at least has the money to afford court costs.
If the only reason you think your software is better is because it's FOSS, you need to write better software

I think the mission for the Ogg people is to promote free media formats. They're probably pretty happy about this.

As of right now, Microsoft is supporting VP8 video as much as it supports Theora video; that is, not at all. Unless the user goes out and installs the VP8 codec, VP8 video won't work in IE9. This is in contrast with H.264 video, which works out-of-the-box in IE9.

And what about companies such as Canonical, HTC etc? Google didn't say they offer patent indemnification to those implementing it and using it.

Copy-pasta from another post I wrote:

If you have webm installed then it will use it for HTML5 video tag. Big difference between add-in codecs that load WMP or Quicktime players and supporting it directly inside the browser.

Well, Flash is the same way (unless the OEM installs it), it's no different than that, which like 95% of people have. Same with Java.

Google launches WebM (container for VP8)

    http://www.engadget.com/2010/05/19/g...-based-on-vp8/

Google has put VP8 out there today; it's now an option on Youtube, and Firefox is supporting it as of today.

MS still says IE9 won't support it out of the box (must download a plugin) but considering the time left before IE9 launches, plus the time after that it will need to become dominant (or more likely just the dominant IE) I'd say Youtube could have pushed VP8 hard enough to force them to include it by default.

The big news is Intel isn't supporting it in hardware (yet).
