I ran check and repair on the HDD from a live disk
Sudo e2fck -cf /dev/sd**
where **is the drive letter and partition number
Then went back to using the open source driver, it seems to be fine...

OK no idea why but switching back to the open source driver seems to have fixed the problem :confused:
