Hello, has anyone tried (recently) to get permission to sell t-shirts? I sent an application and got denied. The strange thing is they said it wasn't allowed under the Trademark Policy and gave me a link: http://www.ubuntu.com/aboutus/trademarkpolicy It doesn't actually say it's not allowed, it says you have to get permission, which is what I tried.

Restricted use that requires a trademark license
Permission from us is necessary to use any of the Trademarks under any circumstances other than those specifically permitted above. These include:
Any commercial use
Use on or in relation to a software product that includes or is built on top of a product supplied by us, if there is any commercial intent associated with that product.
Use in a domain name or URL.
Use for merchandising purposes, e.g. on t-shirts and the like.
Use of a name which includes the letters BUNTU in relation to computer hardware or software.
Services relating to any of the above.
If you wish to have permission for any of the uses above or for any other use which is not specifically referred to in this policy, please email us at trademarks AT ubuntu DOT com and we'll let you know as soon as possible if your proposed use is permissible. Note that due to the volume of mail we receive, it may take up to a week to process your request. Permission may only be granted subject to certain conditions and these may include the requirement that you enter into an agreement with us to maintain the quality of the product and/or service which you intend to supply at a prescribed level.
If you contacted them, and they said no, I do not know what else to say.
Or you could just continue to send them emails for your request.
But if the t-shirts are not going to be making a huge profit, I say make them and sell them, worst thing they can do is tell you to stop, maybe a fine, or buy out your company?

Hehe "company" is too big a word. It's just me and my girlfriend. Yeah, if they had said "We deny your request because we don't feel we should grant it." that would have been fine. What threw me was our trademarks may not be used for commercial purposes so we cannot give you permission to sell t-shirts as you have requested. which is not at all what's written in their policy. Or they could have just put plainly in the policy that it's not allowed.
Them: Rule#2 is "You should ask us."
Me: Well can I?
Them: No, you can't. Because of Rule#2.
Maybe we'll just go do Tux shirts. That's explicitly allowed as long as you give credit where it's due.
