does an upgrade work or does an unistall then new version install have to be done i want the newest transmission installed and got a torrent half way done so should i wait or can i upgrade now?

upgrading will take longer as it will upgrade all of your packages, and install all of the new versions of your packages and the dependencies.

A reinstall will be quicker, but then you will have to re-install all of your apt-get packages.

synaptic package manager says 1.06 is the newest version however the site lists 1.11 http://www.transmissionbt.com/ i did the reload why did this happen?

It could take a while for a release to filter into ubuntu repository. Depending on the application, they sometimes don't even update the repository version.

I'm not familiar with Transmission, being uTorrent user only. In uTorrent, you could move partial downloads around, remove and add back later is not a problem; you just have to recheck the partial file to recover the good bits.

I reckoned Transmission should be the same; it's still a bittorrent client afterall.
