April 21, 2008 (Computerworld) Microsoft Corp.'s attempt to reverse a lower court's ruling in the ongoing "Vista Capable" lawsuit was denied by an appeals court on Monday. The decision means the case can resume.

It also means that new insider e-mails subpoenaed from Microsoft and nearly 30 other companies could be made public.

i dare say a lot more 'dirt' will come out before this case is settled. shows what happens when a corporation becomes so out of touch with staff and customers that they ignore good advice given from managers, oems and retailers, and instigate ill-thought-out practices regardless.

My computer (my first one, I have since sold it) had the "Vista Capable" label, but couldn't run Vista at all. I have Debian Lenny (with GNOME 2.22.0) on a computer with a 700 MHZ processor, and 256 (upgraded from 192, which was upgraded from 64) MB of RAM. It runs a lot better than Vista did on that computer which was mislabeled. Even without the Aero (which it couldn't run) it was super heavy.

I am glad they lost. Anything else aside, that was a very misleading statement and such things shouldn't be tolerated by consumers.

So, can someone sum up what this lawsuit will amount to?

Will I be compensated for buying a "vista capable" PC that can't run Vista?

Read it. It is short.

The appeal was denied, which means the case will continue.

No decisions on the case have been made.
