I was going to move it from the top to the right and it went vertical in the middle of the screen, so then I decided to put it back at the top, and now it is a third of the way down the screen.
restart didn't fix it. Oh I am running 9.10 with compiz.
How do I fix this?

Wow, now it's gone, every time I put the panel to left or right, when I went back to top it would migrate towards the bottom of the screen.
Then, when I select top, it resets itself to bottom but I don't see it anywhere.
It is MIA.

Have you tried right-clicking on panel and selecting "properties" to get dialog shown below? Un-tick "autohide" and use drop-down selection for placement.

Autohide wasn't ticked, I tried every button in the panel.
I guess I have restarted enough times I was able to put it back on top.
Thanks

Don't drag it unless you want to put it in the middle of the screen somewhere. Use the Properties dialog to put it on the side you want, either left, right, top, or bottom. I run 2 panels, left and right, because I have a lot more horizontal screen real estate than vertical. YMMV.
