I don't like the sound of this, I doubt they plan to release source code to the general public under fair terms, and as I understand from the article it would not be the full thing.

Future related news :

- M$ source code leaked into the net.

- Launched new versions of Wine , Cedega , Samba , etc...

- Most distros support NTFS writing out of the box.

- Users in Slashdot get good laughs at the cost of M$ code.

...
offer commercial rivals access to a "pretty significant" chunk of the source code governing communications between servers
...
Software developers will have to pay an unspecified amount for the right to inspect the source code and will be prohibited from publicly disseminating the information

Doesnt exactly sound like Open Source to me.

Not again how many times have the EU let microsoft off they won't get fined.
They will somehow play some kind of politcal move like they always do to get out of paying if anything this is terrible news due to the fact they will only release a small bit of code and to buy rights because that is what you are doing in effect.
Now how much will the rights be to this thats the thing.
To me it looks like MS could profit out of this.
